When a Veteran accrues a debt to the VA as the result of an erroneous or overpayment of benefits the Veteran may ask the VA to waive that debt depending on the circumstances surrounding the debt. Often times these debts occur because the Veteran was not aware of a reporting requirement of a change or a routine audit will discover an error. Regardless of how the debt was created, the VA will most likely recover the debt out of any remaining benefit entitlements leaving many Veterans with little or no income. 38 C.F.R. § 1.962 & 1.963a outline the circumstances in which a waiver may be warranted and the VA Debt Management Center offers numerous options for the Veteran to consider.
