Matter concerns a property that was owned by prospective client’s natural mother who died intestate in October 2018. The death certificate has been recorded against property. Prospective client has two siblings both of whom are willing to let client have ownership of the property under the condition that the siblings inherit the property if the prospective client predeceases them. Thus, the prospective client appears to need an 1) affidavit of heirship (decedent to three siblings); 2) special warranty deed; and 3) the will of a married individual (i.e., prospective client) which disposes of property to siblings and disinherits the prospective client’s own stepchildren as to decedent’s property.
